NA MWANDISHI WETU
MAHAKAMA Kuu ya Tanzania Divisheni ya Ardhi imefuta hukumu iliyotolewa na Mahakama ya Wilaya ya Ilala inayomhusu Lydia Paulo Lugaga dhidi ya Damas Daniel Ndumbaro na kuamuru kusikilizwa upya chini ya Mwenyekiti mwengine.
Hukumu hiyo ya kesi ya Rufaa namba 253/2022 imetolewa Desemba 5,2023 baada ya kuahirishwa mara tatu ambapo mbali na kusikilizwa upya lakini pia imeamuru Lydia Paulo Lugaga kulipwa gharama za kesi hiyo.
Kesi hiyo ya mgogoro wa ardhi iliyokuwa chini ya Naibu Msajili Mfawidhi wa Mahakama Kuu Division ya Ardhi Crecensia Kisongo ilisikilizwa kwa njia ya maandishi kwa pande zote kukamilisha taratibu zilizohitajika.
Uamuzi wa kusikilizwa shauri hilo kwa njia ya maandishi ulifikiwa Septemba 11,2023 baada ya wakili wa Damas Daniel Ndumbaro,Neema Massame kuiomba Mahakama hiyo kusikiliza shauri hilo kwa njia ya maandishi.
Akizungumzia uamuzi wa Mahakama Kuu Divisheni ya Ardhi ,jijini Dar es Salaam Wakili wa mlalamikaji Lydia Paulo Lugaga,Pasensa Dickson amesema wao walikuwa na sababu zaidi ya nane za kupinga hokumu hiyo iliyotolewa na Mahakama ya Wilaya ya Ilala.
Amesema waliwasilisha rufaa yao ya mgogoro wa ardhi kutokana na hukumu iliyotolewa na Mahakama ya Wilaya ya Ilala chini ya Mheshimiwa Kirumbi.
Dickson ameongeza kuwa walikataa rufaa hiyo wakiwa na sababu zisizopungua nane na baada ya kuiwasilisha kwa Mahakama Kuu ilisikilizwa kwa njia ya maandishi.
“Mahakama Kuu ilikubaliana na rufaa yetu na ilitoa hukumu tarehe 5 Desemba 2023 ambapo Mahakama ilijiridhisha kuwa Mwenyekiti wa Baraza la Ardhi la Wilaya alishindwa kuzingatia Kanuni 19 (2)
“Ni takwa la kisheria kwamba katika maamuzi lazima Wazee wa Baraza watoe maoni yao kwa njia ya maandishi ambayo ni maelezo ya kisheria na Mwenyekiti atatoa hukumu kutokana na maelezo ya wazee wote hao.
“Sasa Jaji kapitia hukumu na kagundua kuwa Mzee mmoja wa Baraza hakuandika maoni yake hivyo ameamuru shauri hilo lisikilizwe upya chini ya Mwenyekiti mwingine katika Mahakama ya Wilaya na mteja wangu alipwe gharama zote za kesi hiyo”amesema Dickson
Katika maelezo ya hukumu hiyo iliyoandikwa kwa lugha ya kiingereza, Naibu Msajili Mfawidhi wa Mahakama Kuu Division ya Ardhi Crecensia Kisongo alikubaliana na hoja ya nane ya mkata rufaa.
Naibu Msajili Mfawidhi wa Mahakama Kuu Division ya Ardhi Crecensia Kisongo ameleza kuwa:
Hearing of the appeal proceeded by way of written submissions,where,the appellant was represented by Mr.Pasensa Dickson Kurubone,learned advocate and respondent was represented by Ms Neema Massame,Learned advocate.
“For the reasons that will be advanced later, I will start with the 8th ground of appeal that, the honorable tribunal erred in law by conducting a case in contravention of regulation 19(2) of the Court (District Land and Housing Tribunal)Regulation,G.N.No,174 of 2002.
“Arguing in support of the 8th ground of appeal, Mr. Kurubone submitted that, the trial Chairperson did not require assessors to give their opinion in writing and their opinion were note read to the parties as require by law contrary to regulation 19(2) of the District Land and Housing Tribunal)Regulation ,GN No.174/2002
“I further took time to go through the proceeding of the tribunal and found that ,during the hearing of the matter, the tribunal was composed of two assessors namely ,Mwakalasya and Jokha”ameeleza Naibu Msajili Mfawidhi Kisongo
Naibu Msajili Mfawidhi Kisongo‘ amebainisha kuwa the proceedings of 03rd October,2022 reveal that, the tribunal made an order for the assessors to give their opinion before 07 November,2023.However ,only MWAKALASYA gave his opinion in writing on 03 October.
“I could not find the opinion of Jokha in the proceedings of the tribunal .Regulation 19(2) of the Court(District Land and Housing Tribunal)Regulation ,(Supra)provides that
“Notwithstanding sub-regulation (1)the Chairman shall before making his judgment, require every assessor present at the conclusion of hearing to give his opinion in writing and assessor may give his opinion in Kiswahili,I declare both the proceedings and judgment of the tribunal a nullity and are accordingly nullified.”amebainisha Naibu Msajili Mfawidhi Kisongo
The record should be remitted back to the tribunal for a fresh and expeditious trial before another chairman sitting with a new set of assessors.
